Land Registration is the process of registration or transfer of document, which changes the legal ownership from one person to another. It must be carried out through statutory authorities to ensure the legal ownership and title is guaranteed. Every country adapts different methods in lands and Property registration. In Tamilnadu the Registration of Lands and property is administrated by Tamiladu Registration Department.

Property/Land Check

Before purchasing a land, pay due diligence of property and its title deed. Beware of fraud brokers, go for only genuine and authenticated brokers. If the purchase close through landowners, that will cut down our worries but please pay attention in EC as well. Consult a Lawyer who looks familiar in land registration.

Stamp Paper

Stamp or Stamp paper is where the deed is to be executed. Stamp papers can be purchased through authorized vendors available near your area. They must have to sell stamp paper at the face value of the stamp. If anyone charges more the face value, they are liable for criminal trial, results would get their license cancel with a penalty. You may also buy Stamp Papers from The Sub Registrars, Treasuries, and Assistant Superintendent of Stamps, Chennai. Non Judicial Stamp papers also available at Stamp Sale Counter, 27, Rajaji Salai, Chennai – 600 001. The stamp duty charges may also be paid in DD or Cash.

Sale Deed

Sale deed must be drafted in the stamp per purchased, which was to be done by a profession document writer namely,

 Advocate
 Licensed Document Writers
 Chartered Accountants having Document Writing License.

Be cautious in choosing deed drafters, any mistakes in sale deed may lead us to face legal consequences. Fees for drafting or copying various kinds of deed by the professional licensed writers is prescribed by the Government. All kind of fees should be paid in DD only

Registration

The Registration of property in Tamilnadu must be carried within four months of executing the sale deed. But there is no time for a Will to execute. Delay in Property/Land registration may attract charges as below,

1. Upto 1 week – 25% of registration fee
2. Upto 1 month – 75% of registration fee
3. Upto 4 months – 100% of registration fee

The Property/Land must be registered within the jurisdiction of the Sub-Registrar’s office, where the property resides. If the property/land is done outside the state, it will become null/void.

Documents Required for Property Registration

We need to submit some additional documents to complete the Property Registration,

 Duty stamped signed and executed document
 The claimant of the sale document must also sign in sale deed and also appear before the registering officer for registration of sale deed.
 Patta transfer application with court fee stamp.
 PAN Card
 Patta passbook
 ID card for executant and claimant (for all deeds)
 ID card for witnesses (for power deed only)

After all the processes are over the sale deed will he handed over to the claimant on the same day itself or within 3 days if the office witnesses huge registration on the day.
